Shareholders to Refile Claims in Apple Options Case

Attorneys in a shareholder lawsuit against Apple over its backdating of stock options said Tuesday they plan to refile some of the claims. The shareholders claimed in the June 2006 lawsuit that company directors and officers committed fraud when they backdated some awards made between 1997 and 2001 to time the options when prices were low and boost later payouts.

The backdating of stock options given to executives at Apple did not harm the company's stockholders, said a federal judge in dismissing a lawsuit that made the claim. The complaint, filed by the New York City Employees' Retirement System, asserted the backdating of stock options granted to Apple executives, including Chief Executive Officer Steve Jobs, was illegal and resulted in stock dilution.

Apple released an update to top all updates Wednesday. Included in the massive bundle -- aimed primarily at users of Apple's Tiger operating system -- is the just-out-of-beta Safari 3 as well as about 44 fixes for a spate of security flaws. The software maker's latest batch of updates and security fixes in its combo update weigh in at a whopping 321.5 MB.
